Another Company Accuses Kardashians Of Stealing Name: Chroma & Kroma Vs. Khroma

Last week, the Kardashians were accused of going ahead with the promotion for their Khroma cosmetics brand that allegedly caused confusion in the marketplace for Chroma cosmetics of Beverly Hills.

The owner of Chroma cosmetics sells high-end products and alleged that his business would be harmed by a cheap, nasty drug store brand like the one the Kardashians are shilling under the name Khroma. At the time of its report, TMZ.com noted that another cosmetics company by the name of Kroma (“no “h”) already existed, filed for its trademark in 2010, and secured the rights to use Kroma to promote cosmetics back in January.

The Chroma brand in Beverly Hills who protested first did not secure a trademark, although that was not prohibitive of suing the Kardashians for using Khroma.

Now, sources say the Kroma (no “h”) cosmetics company caught wind of the legal mess and is also angry at the Kardashians for using a confusingly similar name.

The Kardashian family is now fighting TWO makeup wars at the same time… a second cosmetics company has accused the [family] of trademark-jacking.

Kim, Kourtney and Khloe are about to launch a new makeup line which they’re calling Khroma.

Problem is they’ve already received legal threats from a Beverly Hills make-up company called Chroma over alleged name-stealing… and now ANOTHER company has entered the mix.

The new company is called Kroma (no “H”) and according to documents filed with the U.S. Patent and Trademark Office, it already locked down the legal rights to that name back in January.

So when Kroma (no H”) found out about the Kardashian line sources say the [owners] were [angered] and immediately fired off a cease and desist letter to stop [Kardashian] Khroma (with “H”).

[TMZ] obtained official documents which show the U.S. Patent and Trademark office had already REJECTED a trademark request by [Kardashian] Khroma (with “H”) back in September because the name was too similar to Kroma (no “H”).

Kroma (no “H”) recently met with Kardashian reps regarding the [Khroma (with “H”)] trademark, but were unable to come to an agreement, so Kroma (no “H”) is now exploring its legal options. – via TMZ.

It’s not the first time the family has been accused of law-breaking with its brands. The Quick Trim pills are subject of a class action lawsuit for purporting to be diet pills when they’re really caffeine pills with no dietary benefit. The Kardashians promoted Shape-Ups, which offered none of the stated benefits. They promoted the Kardashian Kard that was replete with illegal and “predatory” fees. And several of their clothing and accessory designs were allegedly stolen from real designers with actual talent.
