Judge Rules In Kim Zolciak’s Favor Following Kandi Burruss’ Lawsuit

Kim Zolciak has just won the case brought against her by her former Real Housewives of Atlanta co-star and friend, Kandi Burruss. Earlier this year, Kandi filed a lawsuit, claiming that Kim still owes her money from Don’t Be Tardy, a track Kandi helped co-wrote and produced. Kim said otherwise, and last week, a judge agreed.

In April, Kandi filed the suit (along with co-plaintiff Rodney Richards) against Kim, claiming copyright infringement and unpaid compensation and requesting that Kim be ordered to pay the damages as well as her attorney fees for co-star Phaedra Parks who represented her.

Days after Kandi’s suit was filed, Kim filed a response, requesting that the suit be dismissed and claiming that Kandi was actually overpaid.

According to The Wrap, United States District Judge, William S. Duffey, Jr., issued the following judgement after hearing out both sides:

It is Ordered and Adjudged that the plaintiff take nothing, and the action be, and the same hereby, is dismissed without prejudice. Despite Plaintiffs’ conclusory claim that Zolciak violated some copyright or other intellectual property interest that Plaintiffs assert they had in the Sound Recording, Plaintiffs concede that Zolciak is a co-owner of the Sound Recording, and that she had a right to release it for commercial sale without Plaintiffs’ consent. The Court concludes it does not have jurisdiction over Plaintiffs’ unjust enrichment, accounting and constructive trust claims based upon the sales of the Sound Recording, and these claims are required to be dismissed.

On the morning after her big win, Kim took to Twitter where she posted a short message to fans, proclaiming her victory over Kandi.
