Kris Humphries Wants Prenup & Confidentiality Clause Declared Void

Kris Humphries filed for separation on the grounds that Kim Kardashian committed fraud.

Earlier today, TMZ.com claimed that Humphries prefers indefinate legal separation, that would prevent him ever remarrying, to divorce. However, there’s no legal grounds to prevent his estranged wife ever remarrying nor grounds for fraud. So, that’s not happening.

However, reports RadarOnline.com, Humphries does want his prenuptial agreement and its confidentiality clause thrown out so he can, if he wishes, get his side of the story out there (it’s already out, but leaking through familial sources).

RadarOnline clarifies, were the marriage annulled, the prenup and its gag order would be voided so he could return the favour and smear the Kardashians to his heart’s content.

“The confidentiality aspect of the prenup is extensive and was created just in case things went bad, neither Kim nor Kris could discuss their relationship to the media. But now, Kris wants to be able to talk about the relationship without fear of being sued,” a source close to the situation tells RadarOnline.com.

If the judge does ultimately annul the marriage because of fraud, it’s very likely that the prenup would be tossed because under California law, Kardashian and Humphries were never legally married.

“Kris is getting excellent legal advice. If the judge annuls the marriage, they were never legally married, and the prenup at that point is really moot. Kris wants this to play out in court, and wants the process to be transparent. If this needs to go to trial, he is ready for that. The gloves are off, Kris won’t be a doormat anymore.” – via RadarOnline.
