Lindsay Lohan Checks in to Rehab While Lawyer Hashes Out Rehab Discrepancies in Court

As of 8:45 a.m., Lindsay Lohan checked herself in to Morningside Recovery in Newport Beach, CA-just as her lawyer Mark Heller appeared before the judge.

Lohan was originally scheduled to check in to Seafield Center in Westhampton Beach, NY; a locked facility that was given the “OK” by the judge and prosecutors. However, because the treatment center does not allow patients to smoke cigarettes, Ms. Lohan was not having any of that. Lohan and her 270 wardrobe options, see above, and cigarettes hightailed it to California.

Judge James R. Dabney seemed dumbfounded when he was told by prosecutors that Lohan had not checked in to the rehab that was verified in the plea agreement.

Heller said that Lohan was indeed headed to Seafield Center until a personal and confidential email between him and prosecutor Terry White was leaked to the media causing a threat to the safety of Lohan while enrolled in the rehab program.

“I do not have a problem with Ms. Lohan remaining in the program until the issue is resolved,” Judge Dabney said.  “It appears that Morningside does fall within the parameters but the prosecution should have been give the due diligence to verify this information themselves.”

Prosecutors thought that it was “inappropriate” for Heller to show up five minutes before the hearing with a letter in hand declaring Lohan was in a different facility than one of the six that were originally chosen for her.

Allegedly, patients of Morningside are allowed to go on day trips and even take trips to Disneyland. However, Lohan will have to miss out on all the fun.  The Judge put the kibosh on any chances of Lohan partaking in day trips saying, “she is to do 90 days at a locked facility and by locked she is not to leave.”

The Judge overall seemed fined with Lohan’s new rehab plans and said that White and his team have until May 10 to decide whether or not the program is sufficient for the plea agreement. If Morningside does not meet the conditions of the plea agreement there will be a hearing the week of May 13 to decide where Lohan will end up.

UPDATE: According to TMZ.com, “The treatment facility Lindsay Lohan is currently at has NO LICENSE to provide rehab treatment because its license was REVOKED.”
