Lindsay Lohan In Court This Morning: Facing Possible Jail Time For Probation Violation

Lindsay Lohan’s date in court has finally arrived. Her hearing begins at 8:30 a.m in Los Angeles, and Commissioner Godfrey will determine if Lohan’s probation is revoked.

During the filming of Liz and Dick, Lohan got into a car accident and lied to police about driving the car. She initially blamed her assistant, Gavin Doyle, and hid bottles of alcohol and pills in her trunk.

It has been reported by TMZ.com that Commissioner Godfrey doesn’t favor jail time and prefers rehabilitation options. If Lohan’s probation is revoked, she could be jailed for 245 days. Usually, Lohan avoids consequences for her actions and unfortunately this might not be any different.

Lindsay Lohan may have done it again [and] dodged a jail bullet by the luck of the judicial draw.

Lohan will be arraigned today on three criminal charges, including lying to cops, in connection with her car accident on Pacific Coast Highway in June. We know the judge who will arraign her, Commissioner Jane Godfrey, will formally revoke her probation during the hearing. As you know, she’s on probation for the jewelry heist case.

The Commissioner will order a formal hearing, and if the evidence shows it’s more likely than not that Lohan committed a crime, the Commissioner could send her to jail for as long as 245 days (eight months).

Now the good news… One source very familiar with the Commissioner [says] ”Godfrey is not a big jail person.”

Commissioner Godfrey presides over Drug Court, in which she hears case after case involving people with serious drug cases. Godfrey strongly favors counseling over jail, to the point she has a graduation ceremony for people who complete the program and digs into her own pocket to buy little gifts for the graduates, like Starbucks cards. And the Commissioner presides over Homeless Court where she deals with homeless people who have committed crimes and gets them help to rehabilitate them, instead of throwing them in jail. – via TMZ.

Update 9.05 a.m. 12/12/12: It appears her lawyer Shawn Chapman Holley went to court alone and Lohan was a no-show.

Update 9:45 a.m. 12/12/12: As expected, Lohan’s probation has been revoked and another hearing will determine her punishment.
